Export Compliance

Exports, re-exports and in-country transfers of Blue Coat products, support services and technical information (Blue Coat Technology) are subject to U.S. laws, regulations and executive orders, including without limitation the export controls administered by the Commerce Department’s Bureau of Industry and Security (BIS) under the U.S. Export Administration Regulations (EAR) and the sanctions programs administered by the Treasury Department’s Office of Foreign Assets Control (OFAC).  All parties to a transaction involving Blue Coat Technology are required to comply with these laws, regulations and executive orders. Blue Coat Technology is also subject to European Union (EU) export controls if it is exported from an EU location to a destination outside the EU.  Parties engaged in transactions involving Blue Coat Technology that will be, or has been, exported from the EU should obtain proper export licenses as required under EU rules (Council Regulation (EC) No. 428/2009) and Member State laws.

Blue Coat provides the information on this page as a general guideline and convenience to our channel partners and end user customers who are responsible for exporting, re-exporting or transferring Blue Coat Technology in accordance with U.S. law and the laws of other relevant jurisdictions. 

Embargoed Destinations

Absent an appropriate authorization from the U.S. government, Blue Coat Technology may not be exported or re-exported, either directly or indirectly, to any country embargoed by the United States.  Cuba, Iran, North Korea, Sudan, and Syria are embargoed destinations.

Re-export of Blue Coat Technology

Non-U.S. and U.S. companies re-exporting Blue Coat Technology must comply with both their local export rules and with U.S. re-export regulations.  Please visit the BIS website for Export Guidance regarding re-exports and other offshore transactions involving items of U.S. origin.

U.S. Prohibited and/or Restricted Lists

Blue Coat Technology may not be sold, exported, re-exported or transferred to any person or entity designated as prohibited or restricted by an agency of the U.S. government. Exports to companies, organizations, or persons listed on the Specially Designated Nationals List, the Debarred List, the Entity List, and other governmental lists are prohibited. Please visit the BIS website and review example prohibited U.S. government lists.  In addition, Blue Coat Technology shall not be used to facilitate computer or network disruption, monitoring or tracking that could assist in or enable serious human rights abuses.

Enhanced Proliferation Control Initiative

Absent an appropriate authorization from the U.S. government, Blue Coat Technology may not be used directly or indirectly in the design, development, fabrication, or use of nuclear, chemical, or biological weapons or missile technology.

Blue Coat Product Matrix

The BIS has created the Commerce Control List (CCL) to identify items subject to BIS export license requirements. The BIS assigns an Export Control Classification Number (ECCN), an alphanumeric classification used in the EAR to identify items for export control purposes. The BIS also uses the Commodity Classification Automated Tracking System (CCATS) to assign ECCNs to products it has classified against the CCL.

As a convenience to our channel partners and end user customers, we have prepared the Blue Coat Product Matrix, which provides certain EAR-related classification information regarding Blue Coat’s products, including the relevant ECCN, license exception eligibility, CCATS and HTS codes.
